The conference provided a platform for thought-provoking discussions on the practical applications of FIDIC contracts in arbitration and dispute resolution, with a particular focus on:
- The allocation of design risk and unforeseen delays – and how these challenges impact contractual obligations and dispute outcomes
- Pre-arbitral dispute resolution mechanisms, including the role of Dispute Adjudication Boards (DABs) in ensuring efficient claim management
- Complex procedural issues in construction arbitration, such as managing expert testimony and handling parallel disputes
- The broader implications of FIDIC contract evolution in the context of international infrastructure investment and regulatory changes
