Nikčević & Kapor were honored to participate in “FIDIC in Focus,” an interactive session co-hosted by DLA Piper and ICC Hellas in Athens. This important industry event gathered legal and construction experts to explore the growing significance of FIDIC contracts in international construction projects, their evolving role in dispute resolution, and best practices for mitigating risks in complex infrastructure developments.

The conference provided a platform for thought-provoking discussions on the practical applications of FIDIC contracts in arbitration and dispute resolution, with a particular focus on:

  • The allocation of design risk and unforeseen delays – and how these challenges impact contractual obligations and dispute outcomes
  • Pre-arbitral dispute resolution mechanisms, including the role of Dispute Adjudication Boards (DABs) in ensuring efficient claim management
  • Complex procedural issues in construction arbitration, such as managing expert testimony and handling parallel disputes
  • The broader implications of FIDIC contract evolution in the context of international infrastructure investment and regulatory changes

As part of the program, our Managing Partner, Dr. Jovan Nikčević, contributed to Session 2: Dispute Resolution Issues Related to FIDIC Contracts, alongside a distinguished panel moderated by Stavros Michalopoulos (DLA Piper), featuring:

  • Prof. Constantin Calavros – Managing Partner, Calavros Law Firm – Filios – Kloukinas
  • Natalie Kedikoglou – General Counsel (Greece), Eldorado Gold Corporation
  • Dr. Franco Mastrandrea – Partner, Quantum Expert, HKA

We extend our sincere thanks to DLA Piper, Maryli Paralika, and all participants for their valuable insights and contributions. As FIDIC contracts and arbitration remain at the core of our practice, we look forward to continued collaboration with industry leaders and supporting the development of efficient dispute resolution frameworks in the construction sector. For further discussions or inquiries about our expertise in construction arbitration and dispute resolution, feel free to reach out.
